TAL SpotChecker - Terms and conditions

By participating in TAL SpotChecker, you agree that you have read and understood these terms and conditions.

TAL SpotChecker
  1. TAL Services Limited (TAL) is undertaking an initiative of providing free skin cancer screening for up to 200 participants in total over 2 days to help raise awareness of the risk of skin cancers (TAL SpotChecker).
  2. TAL SpotChecker provides the opportunity for participants to attend the TAL SpotChecker mobile site at Manly Beach to undergo a preliminary skin cancer screening with a qualified health professional provided by Australian Skin Cancer Clinics (otherwise known as Matrix Skin Cancer Clinics Pty Ltd ACN 150 513 223).
  3. TAL SpotChecker is open to anyone over 18 years of age (Participants) however TAL reserves the right to refuse to provide the service to any Participant at its sole discretion.
  4. There is no cost for participation in TAL SpotChecker, no purchase or payment is required from any Participant.
  5. Participants are required to complete the consent form provided alongside these terms and conditions prior to undergoing a preliminary screening at the TAL SpotChecker mobile clinic.
  6. If, once a qualified health professional conducts a preliminary skin cancer screening of a Participant, any irregular spots or lesions are found, the Participant will be provided with a referral to a specialist medical professional for a diagnosis.
  7. TAL SpotChecker provides Participants with a preliminary screening only to identify irregular spots or lesions that should be investigated further by a GP or skin specialist. The TAL SpotChecker screening does not provide Participants with a diagnosis.
Healthdirect
  1. Where Participants have completed the TAL SpotChecker screening and wish to book an appointment with a GP or skin specialist, an appointment can be booked through the Healthdirect Australia Ltd (ABN 28 118 291 044) site (Healthdirect).
  2. Healthdirect is a booking tool that connects Participants with qualified health professionals. Participants are not required to make a booking through Healthdirect but have the option to do so. If a Participant uses Healthdirect, the Healthdirect website terms and conditions will apply.
  3. To make a booking through Healthdirect, Participants will be required to provide their full name, contact number, email address and date of birth. The Healthdirect Privacy Policy will apply to the collection and use of that information.
  4. Healthdirect is not affiliated with TAL, and TAL and its related bodies corporate do not have control over, or responsibility for, booking services provided by Healthdirect or the way in which Healthdirect uses Participant’s information. TAL does not have access to any information provided by a Participant to Healthdirect.
Use of Participant information
  1. When booking an appointment to attend the TAL SpotChecker clinic, Participants will provide TAL with personal information including name, date of birth, email address and contact telephone number. This information constitutes Personal Information (as that term is defined in the Privacy Act 1988 (Cth)). By participating in TAL SpotChecker and providing TAL with that information, Participants consent to the collection and use by TAL of the information provided for the limited purposes set out below. TAL manages the collection, use and storage of personal information in accordance with the TAL Privacy Policy which is available on the TAL website.

  2. TAL will only use the information collected from Participants for the limited purposes of providing reminder communications to Participants to visit a medical professional for skin cancer screening and seeking feedback from Participants on their experience in relation to the screening. Participant information will be stored by TAL for 7 years.
  3. As part of the TAL SpotChecker screening, Participants may provide additional information directly to the health care professional carrying out the screening. This information may include additional contact information for the Participant and information relate to the Participant’s medical history. This information may fall within the definition of Sensitive Information as specified in the Privacy Act 1988 (Cth) and will include any medical notes made by the health professional relating to the Participant during the screening.
  4. TAL will not collect, have access to, or store, any information provided by a Participant to the health care professional at TAL SpotChecker mobile clinics relating to the Participant’s medical history. This information will be retained by the Australian Skin Cancer Clinics. If an irregular spot is identified on the Participant during TAL SpotChecker, as part of Australian Skin Cancer Clinics’ duty of care, the health care professional may complete a follow up process to determine whether advice and/or treatment has been sought by the Participant.
Confidentiality  
  1. TAL will keep confidential all Participant information collected by TAL through the TAL SpotChecker initiative.
  2. TAL will store Participant information in a segregated place on its internal IT system away from any life insurance policy data.
Liability and release 
  1. By participating in TAL SpotChecker, or Healthdirect, Participants agree to release, discharge and hold TAL, and any of its partners who are engaged in this campaign on behalf of TAL, harmless from any claim, cause of action, proceeding or demand that they may have now or in the future connected with TAL SpotChecker or Healthdirect.
  2. To the fullest extent permissible by law, TAL, and any of its partners who are executing this campaign on behalf of TAL, specifically disclaims and excludes any and all liability (including any indirect, incidental, consequential or special loss damage) to Participants that may arise in connection with TAL SpotChecker or Healthdirect.
Governing law 
  1. These terms and conditions are governed by the laws of New South Wales, and TAL and the Participants submit to the non-exclusive jurisdiction of the courts of New South Wales.
